The insured valet was driving a customer`s vehicle when it collided with the passenger side of another vehicle turning at an intersection. The vehicles in the left two lanes next to the valet stopped to allow the impacted vehicle to complete its left turn but the valet driver did not. The valet driver was traveling at 62 MPH prior to applying his brakes and 40 MPH in a 30 MPH zone at impact. Furthermore, it is suspected that the valet may have been on his personal cell phone at the time of the accident. The passenger in the other vehicle died of her injuries and is survived by her husband and two children. She was also a caregiver for her elderly father. The claim ultimately settled for the combined available policy limits of $6M, with reinsurance applying to the $5M excess policy. The insurer was able to recover a portion of the settlement because they purchased a Contributing Excess reinsurance certificate from Berkley Re Solutions.
