The insured driver was traveling in the right lane of a highway when avoiding a truck changing lanes caused him to drop a cup of coffee. When he bent over to retrieve the cup, his truck drifted over onto the shoulder of the road and struck the claimant’s vehicle which was parked on the shoulder while a tire was being changed. The two occupants of the parked vehicle died at the scene. The matter settled for approximately $3.5M and the insurer was able to recover a portion of the settlement because they purchased a Contributing Excess reinsurance certificate from Berkley Re Solutions.
